This DMCA Takedown Policy explains how Friendium, operated by Nexa-Group, responds to claims of copyright infringement in compliance with the U.S. Digital Millennium Copyright Act (DMCA) and equivalent international laws.

1. Legal Basis & Safe Harbor

Friendium qualifies as a service provider under the Digital Millennium Copyright Act (17 U.S.C. §512). Nexa-Group maintains this policy to preserve statutory safe-harbor protections and to ensure prompt, lawful handling of copyright infringement claims.

2. Scope of This Policy

This policy applies to all content hosted, transmitted, indexed, cached, or displayed on Friendium, including user-generated content, profile media, comments, posts, messages, and shared links.

4. Submitting a DMCA Takedown Notice

7. User Notification

Affected users will be informed of the takedown and provided with information on how to submit a counter-notification if applicable.

8. Counter-Notification Process

Users may submit a counter-notice asserting lawful use. A valid counter-notification must include:

  • Identification of the removed material.
  • A statement under penalty of perjury that removal was mistaken.
  • User’s name, address, and contact information.
  • Consent to jurisdiction of applicable courts.
  • A physical or electronic signature.

9. Restoration of Content

If a valid counter-notice is received and no legal action is filed within the statutory timeframe, Friendium may restore the content at its discretion.

10. Repeat Infringer Policy

Friendium maintains a strict repeat-infringer policy. Accounts that repeatedly violate copyright laws may be suspended or permanently terminated without prior notice.

11. Abuse of the DMCA Process

Submitting fraudulent, abusive, or knowingly false DMCA notices or counter-notices may result in legal liability and account penalties. Friendium cooperates with authorities in cases of abuse.

12. International Copyright Claims

Friendium also responds to copyright claims under applicable international frameworks, including EU Copyright Directive and national copyright laws.
