DMCA Policy

Vexor, owned and operated by Nexa Group, respects the intellectual property rights of creators, businesses, artists, and rights holders worldwide. This DMCA Policy explains how to submit valid copyright infringement notices and counter-notices in compliance with the Digital Millennium Copyright Act (17 U.S.C. §512).

1. Introduction

The DMCA establishes a formal process for rights holders to request the removal of copyrighted material used without permission. Nexa Group fully complies with U.S. DMCA requirements as well as equivalent international copyright regulations, including the EU Copyright Directive and global takedown standards.

When Vexor receives a valid DMCA notice, we may remove or disable access to the allegedly infringing content, notify the uploader, and record the incident for repeat-infringer tracking as required by law.

2. Filing a Copyright Infringement Notification

If you believe your copyrighted work has been posted, reproduced, or distributed on Vexor without authorization, you may submit a formal DMCA takedown request. Your notification must contain the following legally required elements:

  • Your full legal name, mailing address, telephone number, and email address.
  • A clear description of the copyrighted work you claim has been infringed.
  • The exact URL(s) or in-app content link(s) where the infringing material appears.
  • A statement confirming that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or legally authorized to act on their behalf.
  • Your physical or valid electronic signature.

DMCA notices that do not contain all required elements may be delayed or rejected.

3. Removal of Content

Upon receiving a complete and valid DMCA takedown notice, Vexor may:

  • Remove or disable access to the infringing material immediately.
  • Notify the user who uploaded the content, including information from the notice.
  • Record the violation on the user’s enforcement history.
  • Preserve necessary logs or evidence for legal compliance or law enforcement requirements.

Content removal under DMCA is not a determination of infringement—only a legal obligation to comply with notice requirements.

4. Submitting a Counter-Notification

If your content was removed due to a DMCA notice and you believe the action was in error or authorized by law (e.g., fair use), you may submit a formal DMCA counter-notice. Counter-notices must include:

  • Your full legal name, address, phone number, and email.
  • Identification of the removed content and the URL where it previously appeared.
  • A statement, under penalty of perjury, that the content was removed due to mistake or misidentification.
  • A statement consenting to the jurisdiction of your local federal court and agreeing to accept service of process from the original complainant.
  • Your physical or valid electronic signature.

5. Restoration of Content

After Vexor receives a valid counter-notification, we will:

  • Forward the counter-notice to the original complainant.
  • Restore the removed content within 10–14 business days unless the complainant files a court action seeking to block restoration.

Vexor cannot restore content if a legal proceeding is initiated during this period.

6. Repeat Infringer Policy

Under the DMCA, Vexor is required to terminate accounts of users who repeatedly violate copyright laws. Enforcement actions may include:

  • Formal warnings or education notices
  • Temporary posting restrictions
  • Shadow limitations or reduced visibility
  • Loss of monetization or creator features
  • Permanent account termination

Nexa Group applies a consistent, escalated enforcement protocol for copyright violations across all platforms we operate.

7. Misuse of the DMCA Process

The DMCA strictly prohibits fraudulent, malicious, or knowingly false takedown notices. Anyone who misrepresents a claim may be liable for:

  • Legal damages
  • Court and attorney fees
  • Penalties under 17 U.S.C. §512(f)

Vexor may suspend accounts that repeatedly submit abusive or bad-faith claims.

8. Fair Use & Legal Exceptions

Uploading copyrighted material without permission does not always constitute infringement. Examples of lawful use may include:

  • Commentary and criticism
  • Parody and satire
  • Educational use
  • Research or analysis
  • Transformative use under applicable copyright law

Vexor does not adjudicate fair-use claims. Only courts can determine whether a specific use meets the legal criteria.

9. International Compliance

Although the DMCA is a U.S. law, Vexor complies with copyright regulations in all jurisdictions where we operate. This includes:

  • EU Copyright Directive (DSM)
  • UK Copyright, Designs and Patents Act
  • Canadian Copyright Act
  • Australian Copyright Act
  • Local laws in Asia-Pacific, Middle East, Africa, and Latin America

International rights holders may file claims using the same DMCA contact channels.
